Terms of Service
These Terms of Service ("Terms") govern your use of Vibe to Live, a service provided by Creative Agntcy, LLC ("Creative Agntcy," "we," "us," or "our"). By purchasing a subscription or using the Service, you agree to these Terms.
1. The Service
Vibe to Live is an AI-powered platform for creating, editing, publishing, and managing websites, proposal sites, landing pages, and other digital assets. The Service includes adaptive intake, AI-generated asset creation, a VTL workspace for editing and publishing, and optional human review or strategic build services.
2. Plans and Payment
- Plans are billed at the rate shown at the time of purchase. Current plans include Free Preview ($0), Instant Live ($29/month), Instant Plus ($49/month), Assisted Review ($199 add-on), Strategic Build (starting at $750), and Custom (scoped individually).
- Recurring plans are billed monthly. Payment is processed by Stripe. By subscribing, you authorize recurring charges to your payment method.
- You may cancel at any time. Cancellation takes effect at the end of the current billing period; no partial refunds are issued.
- We reserve the right to change pricing with 30 days advance notice to existing subscribers.
3. Your Content
You retain ownership of all content you provide (text, images, brand assets). By submitting content through the Service, you grant Creative Agntcy a license to use that content solely to build and maintain your website.
You represent that you own or have the right to use all content you submit, and that your content does not infringe any third party's rights.
4. Acceptable Use
You may not use the Service to:
- Publish content that is illegal, harassing, defamatory, or infringes intellectual property rights
- Attempt to gain unauthorized access to any part of the Service or its infrastructure
- Use the Service for any purpose that violates applicable law
- Resell or sublicense access to the Service without written permission
5. Service Availability
We aim for high availability but do not guarantee uninterrupted access. We are not liable for downtime caused by third-party providers, maintenance, or events outside our control.
Instant assets are AI-generated and available for preview immediately after intake completion. Assisted Review is completed within 2-5 business days. Strategic and Custom builds vary by scope. All timelines are estimates, not guarantees.
6. Intellectual Property
Creative Agntcy retains ownership of its templates, tools, and workflows. Upon full payment of all fees owed, you receive a license to use the website we build for you for the duration of your active subscription.
7. Cancellation and Data Export
You may cancel your subscription at any time through your portal or by contacting us. After cancellation, you have 30 days to export your site data. After 30 days, your data will be deleted.
8. Limitation of Liability
To the maximum extent permitted by law, Creative Agntcy's total liability to you for any claims arising from these Terms or the Service is limited to the amount you paid us in the 3 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.
9. Disclaimer of Warranties
The Service is provided "as is" without warranty of any kind. We do not warrant that the Service will meet your specific business objectives or result in particular outcomes.
10. Governing Law
These Terms are governed by the laws of the State of Georgia, United States. Any disputes shall be resolved in the courts of Fulton County, Georgia.
11. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by email at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
